The 2023 edition of the training event with Gary Friedman and Mario Dotti deals with a very hot topic: how to handle the first mediation meeting after the Cartabia reform. As is well known, the reform abolished the preliminary information meeting, aimed at deciding whether or not to mediate, and introduced a new first meeting in which the mediator must “work so that the parties reach an agreement” and in which the parties and their lawyers “cooperate in good faith” in order to have an “effective discussion of the issue”. What does that mean? That the parties are obliged to mediate and to cooperate? That the mediator must push the parties to settle? And that it must all happen in a single meeting? And how can parties and lawyers be brought to see the opportunity of giving mediation a chance beyond the first meeting, instead of immediately attempting hasty, positional bargaining? In short, how should this new first meeting be handled? You will have the unique opportunity to explore the subject with a world-class mediator and with a long-standing mediator and trainer who knows Italian mediation from the inside. From the mix of Gary’s and Mario’s skills and experience, and with your contribution, strategies, techniques, suggestions and tricks of the trade will emerge, useful to design a new first mediation meeting that: • respects the self-determination of the parties,
- creates effective engagement with parties and lawyers
- lays solid foundations for a mediation that continues beyond the first session.
The course involves intense participation, with a combination of lectures, exercises, role plays and coaching on real cases. It will be held partly in Italian and partly in English with consecutive translation. Training credits for mediators are available.
The workshop will take place in a special setting: a villa in the Monferrato hills near Asti, in Scurzolengo (AT). For two days you will be immersed in nature, far from the “noise” of daily work routine, for a truly unique training experience.
